D

Deed A written instrument (traditionally signed, sealed and delivered by the maker) as proof and record of an agreement, Particular types of deed are named after their functions, e.g. conveyances, mortgages.
Defendant Person against whom legal proceedings are bought.
Development Control The implementation and enforcement of planning standards
Document of Title A Document issued by the Registry of Titles or Land Office showing the registered proprietor under the Torrens system. (See also , Title, Registry Title , Land Office Title, Register Document of Title, Issue Document of Title, Issue Document of Title, Final Title, and Qualified Title.
Dominant Tenement Land owned by one person which enjoys the benefit of an easement or right over neighbouring land (the servient tenement) owned by someone else.

Easement An intangible right which gives one landowner (the dominant tenement) a benefit concerning the utilisation of land owned by another person (the servient tenement), e.g. a right of way, an easement o f light
Easement of light An easement enabling the owner of the dominant tenement to demand that the owner of the servient tenement refrain from obstructing the passage of light to his/her windows.
Entity in the Mukim Register A document of title issued by the Land Office before 1966
Equitable interest An interest in or fight over property not extending to the legal title
Equitable mortgage A mortgage where either the mortgagor's original interest was merely equitable, or a mortgage which was created informally, as by the deposit of title deeds.
Equity of redemption A mortgagor's fight to redeem the mortgaged property, even beyond the day appointed for repayment.
Estate An interest in land, traditionally classified either as freehold (of indeterminate duration), with various sub-classifications (e.g. fee simple), or as leasehold (i.e. of fixable duration).
Estate agent An agent for the sale and lease of real estate.
Estate land Agricultural land of more than 40 hectares which cannot be split without approval of the Estate Land Board
Exchange of contracts In the sale of land, the exchange between the buyer and seller of signed copies of the contract of sale signifying the intention of the parties to be bound by the contract.
Exclusive agency Given to an agent, while not precluding the owner from selling his own property himself, ensures that the agent gets to close the transaction.
Express conditions May be stated in the document of title

Final title Is issued after survey
Fittings Chattels which do not form part of the land, and so must be separately conveyed.
Fixture A chattel so annexed to land as to be considered part of it
Foreclosure Where a mortgages becomes the owner of mortgage property as a consequence of the mortgagor's failure to repay the loan within the extended period for payment.

Freehold estate An interest in land of indeterminate duration
